For the next couple of days, Hurricane Irma continued to cause catastrophic damage throughout Florida including Miami-Dade County, Broward County, Palm Beach County, and Collier County. Despite Florida escaping the “worst-case scenario,” Hurricane Irma damaged homes and property leaving many residents, homeowners, business owners, and tenants with a big mess and a long road to recovery.

After numerous attempts to limit their liability from injuries that occur, commercial businesses aimed at providing entertainment for children have, in-part, succeeded. Fortunately, thanks to the efforts by the Florida Justice Association, the final legislation is far less onerous than the bill that was originally filed. This compromise legislation which was passed during the most recent session of the Florida Legislature authorizes natural guardians of minors to waive claims, in advance, for injuries or death. Prior to this new bill, the Florida Supreme Court held that a pre-injury release executed by a parent on behalf of a minor child was unenforceable against a minor or the minor’s estate in a tort action arising from injuries from participation in a commercial activity. Specifically, this new bill allows natural guardians of minors to waive, in advance, claims for injuries or death arising from risks inherent in commercial activities.

Recently the Florida Supreme Court issued a new Opinion limiting the type of information lawyers can include on their websites. Beginning in June 2010 law firm websites may no longer include testimonials, laudatory statements, and information about past results. While some changes to the current rules were necessary, with the proliferation of advertising it will now be more difficult for prospective clients to determine whether the lawyer they intend to hire has the experience necessary to handle their case. There are however many additional ways to obtain that information. The first and most obvious way it to simply ask the lawyer, over the phone or at the initial meeting, to tell you what qualifies them to represent you.
